Religious organizations to rent state and communal property hors concours

According to alterations to the Law of Ukraine "On the Rent of State and Communal Property," the right of religious organizations to rent state and communal property hors concours has been preserved. The alterations came into effect on 1 January, 2011, reports the Institute of Religious Freedom.

The alterations came into effect on January 1, 2011, reports the Institute of Religious Freedom.

"Lease of state and communal property is effected solely on the competition basis, except for the state and communal property leased to: ...religious organizations for serving divine services, religious rites and ceremonies," reads the first paragraph of Item 7 of Article 9 of the law.  

The article of the law also reads: "The rate of rental approved by the Cabinet of Ministers of Ukraine for state property are indicative and are used as starting ones during the competition for the right of rent of communal property in the cities of regional significance and in the cities of Kyiv and Sebastopol."

One should note that in recent years, norms of the similar content were included in the Law on State Budget of Ukraine for the current year. However, on December 23, 2010, the Supreme Council passed the Law 2856-VI of Ukraine "On Making Alterations to the Budget Code of Ukraine and Certain Other Legislative Acts of Ukraine," by which the mentioned benefit was preserved for religious organizations on the permanent basis.    

In addition, on January 1, 2011, the term of action of Resolution 316 of 25.03.2009 of the Cabinet of Ministers of Ukraine, which fixed benefit rental rates for state and communal property at the rate of 45% for most of the subjects of economic activities, including religious organizations, has expired.   

The current rental rate for religious organizations is 3% on condition that the rented objects are located on land plots that are not used for entrepreneurship activities and cover an area no larger than 50 square meters.

The mentioned rates are fixed in Addendum 2 to the methods of settlement and procedure of use of rentals for state property, approved by Resolution 78 of   04.10.1995 of the Cabinet of Ministers of Ukraine.  

Let us remind that on July 1, 2010, the government increased the cost of rent of state and communal property for religious and other nonprofit organizations nearly by two times by way of reduction of the benefit.
